Consumer Health Data Privacy Notice

This notice supplements WellnessMAP's Privacy Policy and describes how we collect, retain, use, and disclose any Consumer Health Data ("CHD") that we may collect. This Notice applies to the residents of Washington and Nevada.

"Consumer Health Data" means personal information that can be linked or reasonably linked to a consumer and that identifies past, present, or future physical or mental health status. Consumer Health Data includes information about bodily functions, vital signs or symptoms, medical conditions, diagnosis and treatments, as well as non-medical information, such as social or behavioral interventions, surgeries or other health-related procedures, the use or acquisition of medication, biometric or genetic data, information about use of non-prescription health-related products, and non-health information, such as precise location information, that could reveal reproductive or sexual health care, or gender-affirming care, including, without limitation, proxy or derivative information, or information that is extrapolated from non-CHD data, inferred or emergent data derived through an algorithm, machine learning or any other means.

Please note that this Notice does not apply to how we process protected health information ("PHI") subject to the Health Insurance Portability and Accountability Act ("HIPAA").

Categories of CHD Collected

We collect CHD directly from you. We may collect data you voluntarily provide regarding your health and daily habits as you respond to our health survey and as you communicate with us or through using our AI chatbot. This may include sleep duration, food intake, meal timing, stress levels, light exposure, mood, toxins, health conditions, and physical and mental health status and symptoms. This may also include any audio recordings or images you upload as you respond to our health survey.

Purposes of Collecting CHD

We collect CHD for the following purposes:

• Provide our services, including to provide nutritional analysis.
• Respond to our users' inquiries or to provide support.
• Manage, analyze, and improve our services.
• Analyze and better understand consumers' needs, preferences, and interests.
• Conduct internal business analysis and research.
• Comply with our legal and regulatory obligations, and enforce our rights and policies.
• Administer, monitor, and secure our information technology systems, including by detecting and preventing against security incidents and fraudulent activity.

How CHD is Collected

We collect CHD when you voluntarily provide that information to us when you complete our health survey or otherwise engage with us.

Who We Share CHD With

We may share the CHD that we collect with the following categories of entities:

• Service providers;
• Government entities, including judicial and regulatory authorities or law enforcement, and other entities as required by a valid legal subpoena or court order;
• Successors or potential successors to all or part of our business in connection with a business transaction, such as a merger, acquisition, joint venture, financing or similar;
• Third parties in connection with a legal right or obligation, including the establishment, exercise, or defense of legal claims; to comply with laws or to respond to lawful requests and legal processes; to protect our rights and property and the rights and property of others, including to enforce our agreements and policies; to detect, suppress, or prevent fraud; to protect the health and safety of us and others; or as required by applicable law; and
• Others with your consent or at your direction.

De-identification of CHD

For our internal business analysis and research, we may de-identify or aggregate our users' CHD. We take reasonable measures internally to, and also require our service providers to, ensure that the information cannot be associated with an individual. We do not attempt to re-identify the information and will maintain and use the information in the de-identified form. After it has been de-identified, the information is no longer personal information and is not subject to this Consumer Health Data Privacy Notice.

Selling or Using CHD for Targeted Advertising

We do not sell your CHD and we do not use your CHD for targeted advertising.

Your Privacy Rights

You may have certain rights with respect to the CHD that we have collected about you under the applicable privacy law. They are:

• Right to Withdraw Consent: You have the right to withdraw your consent to the processing of your CHD.
• Right to Confirm and Access: You have the right to request confirmation of whether we are collecting, sharing, or selling your CHD and to access such data.
• Right to Know: You have the right to know the third parties with whom we have shared or disclosed your CHD and the contact information such as an email address or other online mechanism for these third parties.
• Right to Request Deletion: You may delete your account features at any time, and you also have the right to request that we delete your CHD.

You may exercise your privacy rights with respect to CHD twice in a twelve-month period at no charge.

How to Exercise Your Privacy Rights

To exercise any of your privacy rights described above, please submit a verifiable consumer request to us by either calling us at 1-800-816-8184 or submitting a request by sending us an email to privacy@wellnessmap.ai and use "Consumer Health Data Privacy Request" as the subject line.

We will need to verify your identity to a reasonable degree of certainty before acting on your request. If we are unable to verify your identity and the validity of your request, we may decline your request. Alternatively, we may need to contact you to collect any additional information needed to respond to your request. Any additional information collected in connection with your rights request will only be used for the purpose of responding to your request. If we decline your request, we will let you know within the time to respond under the applicable law (generally within 45 days of receiving your request) and provide you with a method of appealing our decision.

Updates to this CHD Privacy Notice

We reserve the right to amend this Notice at our discretion and at any time. If we change the way we collect, use, or disclose your Consumer Health Data that require us to make changes to this Notice, we will post a notice on this page and update the effective date. Your continued use of our website, mobile app, or our services following any posted updates constitutes your acceptance of such changes. If you object to any of the changes, you must stop using the sites or our services.
